Mastercard Responds to Industry on Enforcement Actions

In last week's Convenience Distribution News, we shared that CDA, NATO, NACS and EMA sent a letter to Mastercard regarding its recent enforcement actions against retailers selling certain electronic nicotine delivery system (ENDS) products. Mastercard threatened to issue substantial fines to retailers selling ENDS products that are not among the U.S. Food and Drug Administration's (FDA) currently authorized products, even though many of these products are covered by pending PMTAs. On July 27, 2026, Mastercard responded, “In light of additional information being provided to Mastercard regarding the acquirers’ specific merchant customers – we have decided to temporarily pause any assessments to provide customers additional time to execute their remediation plans and ensure compliance.” CDA will continue to monitor this issue and encourages Mastercard to permanently eliminate the assessment.
