DOL Reinforces English Language Proficiency Requirements for Foreign Workers Operating Commercial Motor Vehicles

On May 14, 2026, the U.S. Department of Labor (DOL) issued new guidance clarifying that employers seeking to hire foreign commercial truck drivers must include federal English language proficiency requirements in all job postings and labor certification applications.

The guidance reinforces existing federal rules requiring commercial drivers to be able to read traffic signs, communicate in English with law enforcement and the public, and complete reports and records. Employers that fail to include these requirements could face delays in processing their labor certification applications until corrections are made.

The policy will take effect 30 days after publication and primarily impacts distributors, trucking companies and other employers that sponsor foreign CDL drivers.
