Upcoming Omnibus Bill Could Be “Deemed” Beneficial for CDA Members

Facing a looming March 23 deadline, Congressional leaders are working to finalize the fiscal year 2018 spending package to avoid another shutdown. There is some appetite to include the Cole-Bishop bill, otherwise known as the FDA Deeming Authority Clarification Act, but there are indications that Democratic leadership in the Senate is adamant that the provision not be included in the more than 100 “riders” being considered. Today, CDA weighed in with House and Senate leadership about the importance of the provision and we are hopeful that negotiations will result in the inclusion of the provision in the final omnibus spending package.

Our provision is not the only contentious issue being debated. Democrats oppose a number of policy riders they say will weaken important environmental regulations, while Republicans in both chambers are split on a bill that would allow states to require that certain online retailers pay sales tax.
