Juul Sues FDA for Documents Related to Product Denial Order

Juul Labs Inc. is suing the Food and Drug Administration (FDA) to obtain documents related to an order banning the company’s vaping products from the market. The FDA initially banned Juul’s products on June 23, citing a lack of evidence defending their safety and noting their “disproportionate role in the rise in youth vaping.” On June 24, Juul won an emergency court order temporarily blocking the FDA’s decision.

Juul accused the FDA of violating the Freedom of Information Act (FOIA) by withholding a majority of the "scientific disciplinary reviews" underlying the sales ban, according to the complaint filed in a court in Washington, D.C. The complaint states, "The public deserves a complete picture of the scientific facts behind one of the agency’s most controversial and closely scrutinized decisions in recent years, especially where even FDA recognizes its order is suspect."
